Release

By submitting your story, you affirm that your submission is true and accurate, and you grant to Genesis Motors Canada (a division of Hyundai Auto Canada Corp., herein “Genesis”) the unrestricted right and permission to use any photographs that you submit and to use your names, image, voice, likenesses, story or anecdotes, and any comments arising out of the your submission, and any other materials you provide, in whole or in part, and to use, edit, present, transmit, share with any other party, and display the same, without restriction as to changes or transformations, in connection with its business, in all forms and media now known or hereafter developed, without payment of royalties. You understand that Genesis may choose, at its absolute discretion, to feature your story or details of your submission on its website or in other media.

You knowingly and voluntarily hereby fully release, hold harmless and forever discharge Genesis, and its past, present, and future employees, officers, directors, shareholders, principals, agents, attorneys, representatives, predecessors, assigns, subsidiaries, divisions, and affiliates (collectively the “Genesis Parties”) from any and all manner of past, present or future rights, claims, demands, and cause of action, in law or in equity, in tort or in contract, or under any other theory of recovery (each, a “Claim”), arising out of your submission or your involvement in any programs, events, or experiences to which you may be invited by Genesis as a result of your submission (each, an “Experience”), regardless of the nature of the Claim, which may include but is not limited to Claims for: (a) personal injury, property damage or other losses or costs sustained or incurred by you; (b) technical errors related to computers, servers, providers, or telephone or network lines; or (c) any other type of error in the administration of any Experience whether known or unknown, whether now existing or hereinafter arising, which you ever had, now have, or may have hereafter against the Genesis Parties. You further acknowledge that some Experiences are arranged or delivered by a third party over which Genesis does not have control. You understand that only in some instances may Genesis offer Experiences to Genesis owners, and there is no obligation for Genesis to offer such Experiences. You understand that any Experience which may be made available to you is made available at the absolute discretion of Genesis and is not promised to you. If in the course of offering or arranging an Experience for you, any of the Genesis Parties or any third party is unable to deliver on the Experience due to any events or causes beyond their control, such as event cancellations or any other cause, in no instance will any Genesis Party or third party be obligated to provide the Experience or any other substitute for the Experience. Any costs or expenses associated with an Experience which Genesis has not specifically identified and advised you that it will cover will not be covered by Genesis.

You agree to indemnify and hold Genesis and its subsidiaries, affiliates, officers, directors, agents and employees harmless from any claim or demand, including reasonable attorney’s fees, made by any third party due to or arising out of your breach of any terms and conditions which may apply to your submission, your participation in any Experience, or your violation of any law or the rights of a third party. Genesis’ failure to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches.

Any disputes arising out of or related to your submission or participation in an Experience shall be handled individually without any class action, and shall be governed by, construed, and enforced in accordance with the laws of Ontario.

You understand that the Genesis Parties are not responsible for lost, interrupted or unavailable network server or other connections, miscommunications, computer, or technical failure.

You understand that your submission and any potential participation in an Experience does not constitute a contest.

Consent to receive commercial electronic messages.

I consent to Genesis Motors Canada, a division of Hyundai Auto Canada Corp. (“Genesis”), Genesis Distributors, and Genesis Finance (123 Front Street West, Suite 1900, Toronto, Ontario M5J 2M2) sending me emails and other commercial electronic messages covered by applicable anti-spam law about services, surveys, marketing material, product information, promotions and offers that may be of interest to me and about any other matters described in Genesis’s Privacy Policy, and I also consent to the use by such entities of the personal information I have provided for these purposes. I understand that at any time I may withdraw my consent to receiving emails and other commercial electronic messages. I consent to Genesis and Genesis Distributors using the personal information that I have provided in order to contact me via channels other than email and other commercial electronic messages covered by applicable anti-spam law about services, surveys, marketing material, product information, promotions and offers which may be of interest to me and about any other matters described in Genesis’s Privacy Policy. I understand that information may be shared with the Genesis service providers described in the Privacy Policy for these purposes. I understand that I may at any time withdraw my consent.
